General Information

These terms and conditions govern purchases made from Frantoio Galatea, including through any e-commerce website, social media channels, e-mail, telephone, or other distance selling channels. The Customer is invited to read this document carefully before placing an order.

For consumers, distance purchases are regulated by Italian Legislative Decree No. 206/2005, the Consumer Code, as subsequently amended, including the provisions implemented by Legislative Decree No. 21/2014 concerning consumer rights.

Definitions

“Seller”: Frantoio Galatea, with registered/operational address at Via San Vito 16, 80065 Sant’Agnello (NA), Italy.

“Customer” or “Consumer”: the natural person who purchases for purposes unrelated to their business, commercial, craft, or professional activity.

“Products”: olive oil and other goods marketed by the Seller.

Subject Matter and Scope of Application

These terms and conditions apply to all sales concluded by the Seller, unless otherwise agreed in writing. Any special conditions applicable to individual offers, promotions, customized packaging, or international sales will be communicated before the order is finalized.

Product Information  

The Seller describes the products as accurately as possible, indicating, where applicable, size, ingredients, characteristics, price, any preparation times, availability, and delivery methods. Images are for illustrative purposes only and may not perfectly represent the packaging, colors, or details of the product received.. 

Orders and Conclusion of the Contract

The order is considered received when the Customer submits the purchase request with all the necessary information. The contract is considered concluded when the Seller confirms the order and/or receives payment, unless a different procedure has been communicated to the Customer.

The Seller may refuse or cancel orders that are incomplete, unpaid, related to unavailable products, contain incorrect data, or come from areas not covered by the shipping service. 

Shipping and Delivery

Products will be shipped to the address provided by the Customer. The Customer is responsible for ensuring that the delivery details are correct and complete. Shipping times and costs vary depending on destination, weight, volume, product availability, and the courier used.

Any delays caused by couriers, force majeure events, holidays, incomplete addresses, storage at courier facilities, or customs checks shall not be attributable to the Seller. Upon delivery, the Customer must check the integrity of the packaging and promptly report any irregularities.

Right of Withdrawal

The Consumer has the right to withdraw from the purchase, without any penalty and without providing a reason, within 14 calendar days from receipt of the products, except for the exclusions indicated in this document.

To exercise the right of withdrawal, the Customer must send written notice to the Seller within the above-mentioned period, by e-mail, certified e-mail, registered letter with return receipt, or any other suitable means, indicating the intention to withdraw, the order number/reference, the Customer’s details, and the products subject to withdrawal.

The Customer may use the optional withdrawal form provided at the end of this document, but use of the form is not mandatory.

Return procedure

After sending the withdrawal notice, the Customer must return the products within 14 days from the date on which they communicated their intention to withdraw.

Te products must be carefully packaged to avoid damage during transport. Return shipping costs are borne by the Customer, unless otherwise agreed in writing or provided for by law.

Refund

Once the returned products have been received and their integrity has been verified, the Seller will refund the amounts due within 14 days from the withdrawal notice. The Seller may withhold the refund until the products have been received or until the Customer has provided proof of having sent them back, whichever occurs first.

The refund will include the price paid for the returned products and, where due, the standard shipping costs incurred for the initial delivery. Any additional costs resulting from a delivery method other than the least expensive standard delivery offered by the Seller are excluded.

The refund will be made using the same payment method used by the Customer for the order, unless otherwise agreed. The Seller may reduce the refund in the event of any decrease in the value of the products resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.

Damaged, Incorrect, or Non-Conforming Products

In the event of a damaged, incorrect, or non-conforming product, the Customer must promptly contact customer service, preferably within 48 hours of delivery, attaching photographs of the packaging, the product, and the shipping label. This communication facilitates the handling of the claim with the courier and does not limit the rights granted by law.

Where the defect or error is confirmed and attributable to the Seller, the Customer may be entitled, depending on the case, to a replacement, refund, or another agreed solution.

Changes to the term of conditions

The Seller may update these terms and conditions at any time. The applicable version is the one published or communicated to the Customer at the time of the order, unless changes are required by mandatory legal provisions.
